AL'S PROBATE CORNER ONE STOP FILING If a full estate filing is not necessary, then one simple filing would suffice. If there are no Probate Assets, i.e. no assets owned solely by the Decedent, then the filing would be for Tax Purposes Only (TPO): Affidavit for Filing Will not submitted for Probate (with Will) CT-706NT-listing date of death values of all assets If there are some Probate Assets (no real estate), but not enough for a full estate, i.e. less than $40,000 in value, then the filings would be: Affidavit for Filing Will not submitted for Probate (with Will) Affidavit in Lieu of Administration - listing all Probate assets and debts CT706NT Please note there is no Court order issued in a TPO, but the Court does order how the assets will be distributed in an Affidavit in Lieu of Administration Filing. Since creditors are only paid from Probate Assets and there are specific debts that have priority over other debts (e.g. funeral expenses) a Decedent's unsecured debts (e.g. credit cards) should not be paid until the Court orders payment.
