In simple terms, Probate is a local (usually two towns) court that primarily deals with the orderly transfer of assets of a person who has died ("Decedent"). The Probate Court reviews the assets of the Decedent, the will, and any other applicable documents to determine who can rightfully transfer assets and who gets the assets or proceeds of a sale. Because of the Probate Court, the new owner gets "good title." Misguided fears of Probate are largely due to a lack of understanding. With proper knowledge, and the right Judge, the Connecticut Probate Court can be quite beneficial. As Judge, I will educate the community about Probate through seminars and an "open court" policy.
